Agreement with Terms of Use 

This agreement sets forth the terms and conditions that apply to use of the Developreneurs website by any individual accessing Developreneurs.com, including but not limited to persons posting web develoment projects ("Visitors"), and persons or businesses responding to projects ("Service Providers"). By accessing Developreneurs.com, you agree to the following terms and conditions. If you do not agree, you have no right or license to access Developreneurs.com.

Services

Developreneurs is a free, on-line communication service for persons seeking web development services. Visitors desiring to complete web development projects, may advertise, without charge, their need for web development services utilizing the forms provided at this website and in accordance with the terms, conditions and rules set forth herein. 

Responsibilities of Visitors Requesting Services

Any information submitted by Visitors must be true, correct and accurate to the best of their knowledge. Any information submitted by Visitors may be relied upon by Service Providers. Visitors agree not to post any contact information in the project description field to prevent unqualified Service Providers from responding to the customer's project request.

Under no circumstances may the project request boards be used as a method of advertisement for any individual or business. Visitors agree to only post valid project requests and limit contact information to the appropriate fields.

Visitors may not request or suggest any services which are unlawful, abusive, threatening, harmful, obscene, lewd, offensive, defamatory or otherwise objectionable, including but not limited to, any type of adult related website. Visitors agree not to upload, post or otherwise transmit through or to this website any content that might infringe the intellectual property rights, privacy rights, rights of publicity, or other proprietary rights of others.

Visitors who post a project and secure the services of a provider must notify Developreneurs which provider they selected.

Responsibilities of Service Providers

All Service Providers agreeing to accept projects posted on the Developreneurs website represent and warrant that they are duly and legally qualified to provide all services requested, and agree to comply with all federal, state and local laws regarding the provision of such services. 

Companies interested in providing sought-after web development services may contact the persons with projects only by utilizing the means provided by Developreneurs. Service providers agree not to contact Visitors directly without first being contacted by Visitors regarding a bid proposal submitted by the service provider.

Service providers will notify Developreneurs immediately, whenever a project is contracted. Service Providers agree to pay a commission fee of 5% to Developreneurs within 10 business days of receiving payment from the client. Service Providers failing to comply with the payment agreement will be terminated, and responsible for all commissions due, plus any additional collection fees incurred by Developreneurs in an effort to collect payment, including, but not limited to, legal fees, and professional collection service commissions.

Negotiation of Services

All aspects of services related to customer project requests, including, but not limited to, work to be performed, methods or amounts of payment, and time frames, will be the sole responsibility of the customer and service provider. Any and all claims need to be dealt directly with the service provider. Visitors and Service Providers agree to hold Developreneurs harmless in all financial matters between any parties involved in services provided as a direct or indirect result of requests posted on Developreneurs.

Indemnification by User

All persons utilizing our services agree to indemnify, defend and hold us and our affiliates, business partners, officers, directors, employees and agents harmless from any loss, liability, claim, demand, damage, or expense asserted by any third party relating in any way to your use of this website or breach of any terms stated herein.

No Warranty; Limitation of Liability

Developreneurs does not make any warranty, express or implied. The web development request service is free to the public, and those persons choosing to utilize its services, do so on an "as is basis" and all warranties are disclaimed by Developreneurs. Those persons desiring to utilize the communication services offered by Developreneurs do so at their own risk and agree to hold Developreneurs harmless for any and all actions, claims and suits. Under no circumstances, including, but not limited to, negligence, shall Developreneurs be liable for any direct, indirect, incidental or consequential damages that result from the use of, or the inability to use, the Developreneurs web development communications board properly.

We make no representations concerning the content of development websites listed in any directories located on Developreneurs.com. Consequently, we cannot be held responsible for the accuracy, relevancy, copyright compliance, legality, or decency of material contained in such sites.

Lawful Use

All Visitors and Service Providers shall use Developreneurs.com for lawful purposes only. Visitors and Service Providers shall not post or transmit through Developreneurs.com any material which: (a) violates or infringes in any way upon the rights of others; (b) is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable; (c) encourages conduct that would constitute a criminal offense, gives rise to civil liability or otherwise violates any law.

Termination of Services

Developreneurs reserves the right to terminate access or remove postings of any Visitor or Service Provider violating the terms, conditions and rules herein. Because Developreneurs operates on a commission payment honor system, Developreneurs reserves the right to terminate any Service Provider account based on confidential information. Service Providers agree to accept all decisions by the administration of Developreneurs regarding access to Developreneurs.com as final. Service Providers using Developreneurs.com agree to hold Developreneurs harmless, and will not pursue litigation against Developreneurs concerning any and all account access and or termination matters.
